In Virginia, if the video was seized as evidence, it is shielded from FOIA requests during the investigation and or trial.

Also, the prosecution would not be allowed to release the video under the bar ethics rules because of what you mentioned. But the police would not be under the same constraints and could do so, but it would be in poor form imo until the criminal case got going in court.

In the area I work, investigative journalism isn't as prevalent, so it is here.

In other parts of the state, and in select situations here, there might be a release.

If there was no public out cry, there would probably not be a release.
