how does this work? the last time i checked, prostitution is illegal. or this just another rich guy not getting due process?

While I agree its illegal does anyone ever do time for hiring a prostitute or just some kind of slap on the hand. The man lost his job had to deal with his family so he really has paid his price for his actions. It looks like they covered all the other legal issues and only found he was guilty of hiring a prostitute. Now if they had found that he was involved in other stuff then I would agree he would need to face them in court.

thats kind of my point. if they were going to spend tax payers dollars doing an investigation, then they should follow up with charges.

I'm wondering if anyone read the 2nd link, here's a quick highlight of why they aren't going forward with charges:

In laying out his decision not to prosecute Mr. Spitzer, Michael J. Garcia, the United States attorney in Manhattan, said he had three main rationales: Mr. Spitzer had apparently not used any public money or campaign funds for his trysts; there was insufficient evidence that he had broken the law in how he had structured payments to the call-girl ring; and, finally, it was not the policy of his or other federal prosecutors’ offices to charge the customers in matters of prostitution.

Patricia A. Pileggi, who once prosecuted public corruption cases in Brooklyn, agreed with Mr. Garcia that the federal government does not, as a general rule, prosecute johns in prostitution cases. She said that she once represented a madam in a criminal case and recalled that the clients in the matter were never charged, despite there being evidence to do so.

“What I’m seeing,” Ms. Pileggi said, referring to Mr. Garcia’s decision, “is completely consistent with how they’ve handled other matters.”

Cost to much to incarcerate someone for CS stuff like that.

Read Matty's post they looked at other things in the invetigation dealing with other things that could have been more serious crimes. I think they just concluded that he just used a prostitue and that was just not enough to hold a trial.

You have to conduct a proper investigation before determining if it's worth bringing charges.
