Your analogy is backwards...a parallel one would be a city building code that says ceilings must be 7 feet high at a minimum and doorways must be 6.5 feet high. You're 6'7" and you STILL follow that regulation and put in 7-foot ceilings in your house...then are surprised when you're constantly cracking your skull and can't raise your arms up.

When dealing with regulations, you have to make sure the people and contents of the building can comfortably and safely inhabit it. This is where Jerry failed.
