You can't be all willy nilly with the death penalty.
(And before you jump and call me a bleeding heart liberal (I am), I don't feel one way or another about the death penalty. It'd be no skin off my back if they kept it or made it illegal) But if you're going to throw someone in the chair. Intent means a lot. Didn't these guys get spooked and shot ST? That's no reason to fry someone. Now if they came in with the intention of shooting him, that's totally different. It's f'ed up and I have no problem with them rotting in prison for the majority of their life but... Come on.

The use of the quoting of scripture is no different than providing a source for information that backs up our statements. We do this in every thread to support our ideas by using various references. I do not always like the sources that people use to back their arguments (especially Wikipedia), but I am not going to get upset because they used them. |

He didn't pull the trigger. This man was a criminal and participated in a robbery that went horribly wrong. He deserves the punishment he is receiving. He's not making excuses - he's showing remorse and trying to make whatever amends he can. i am baffled at how people refuse to show him compassion, while we're easy to forgive a cowboys player who chose to drink and drive and killed (essentially pulling the trigger) his friend. Both men knowingly broke the law. Both knowingly engaged in activities that put other people's lives in danger. Neither man intended to harm another person. So why do we rush to forgive one man yet wish evil on the other? There are two purposes for the prison system - to protect society and to reform criminals. This man seems to be on the right path towards being reformed. When he's eventually released from prison, he will hopefully be fully reformed. What more do we want from him?

I understand that it is commonplace for lawyers to engage in various delay tactics.
Nonetheless sadly there is nothing "speedy" about these "fair and speedy" trials. You'd think we were in India, where justice moves at the speed of molasses flowing uphill.

Have to agree here. Even with no intent if I walked into an elementary school right now with a gun I would most likely be arrested. If a person pulls a gun, there is intent to inflict harm with it, regardless of if its physical or mental harm.

I agree there as well. Regarding the accomplices who did not have guns or pull the trigger (such as the subject of this post), i feel the punishment should be a little lighter if they didnt know their friend was carrying a gun. If they knew he had a gun, then i agree with the harsher punishment. I imagine the later is the case here, since he received sucha long prison sentence.

I would agree if the wording were changed to 'If a person pulls a gun in the commission of a crime, there is intent to inflict harm with it, regardless of if its physical or mental harm'.

... and, if the crime is a felony (as in the Taylor burglary),it's considered felony murder which is treated as first degree murder and the legal equivalent of pre-meditated murder.
