It shouldn't be totally assumed that this happened when it has been disputed by the person accused.

Agreed. Everyone kind of said "Mike Carey the ref is a very upstanding man." So all of a sudden that meant he was right?? Did he see something, or did he THINK he saw something? He may be an upstanding guy, but upstanding people are capable of mistakes too.
