Actually, I think it means he is leaning towards a dismissal. Not sure about the Federal Rules but, in Maryland, a Judge cannot grant a dispositive motion without a hearing i.e. judge's can't dispose of a case through dismissal or summary judgment without an oral hearing giving each side a chance to make argument.
Alternatively, he could have denied the Motion to Dismiss without a hearing which then would have moved the case into the discovery phase.
Right now it is in limbo - not moving forward, but not dismissed.
I'll check the Federal Rules when I get into work.
Gotcha, I thought he had actually dismissed the request for dismissal, but you are right, he just said he would hear arguments on whether to dismiss the case.
As Dirtbag said "My god the courts are slow!"

I have forgotten all about this....lol! My #1 concern right now is getting Griffin's contract signed and him out there practicing.

'Cause everybody sues everybody ... and then there all those silly criminals to deal with.
It's not the only case on the docket. Everybody wants their case expedited. blah blah blah.
If only we had robots doing it.

I really thought it was because lawyers tend to write real long boring prose. Therefore it takes longer to trudge through the motions when you are falling asleep every 5 pages.

I reiterate my earlier posts ... if this makes it past the Motion to Dismiss, there is going to some fun in the discovery phase.
They should sell tickets to Mara's deposition.
Unfortunately, there will be no tickets. I think this also spells the end of any hope for cap relief next year. I haven't read the decision, but it appears Judge Doty ruled that the players waiver encompassed any violations that occurred during the cap free year.
