Mc2guy 06-16-2010, 05:12 PM ^^ Are you sure that's true? It says it's a signing bonus that's not prorated b/c its voidable at the players option. If it's not prorated, I don't think the club can reclaim a portion of it.
What it says is that the team can go after a prorated portion of a signing bonus if a player renegs or "willfully or substantially undermines their ability to contribute to training camp or regular season" according to the CBA.
Since the prorated period for the contract is 2010-2015, then as I read it, this is year one and they can go after all of it. If he lays down in 2011, they would only be able to go after 16.8M (21 - 4.2).
I guess it comes down to how an arbitrator would rule on the definition of "willfully or substantially undermining" and how the proration of the bonus would work. Regardless, the Skins have a position legally to allow them to recoup their bonus money if Fatty doesn't play ball. Had they not converted the Option to a Signing bonus, they would have zero recourse.
Mc2guy 06-16-2010, 05:24 PM Here is the exact language from the CBA, which can be found here:
CBA-Download - NFLPlayers.com (http://www.nflplayers.com/about-us/CBA-Download/)
Section 9. Limitations on Salary Forfeitures:
(a) No forfeitures of signing bonuses shall be permitted, except that
players and Clubs may agree: (i) to proportionate forfeitures of a signing
bonus if a player voluntarily retires or willfully withholds his services from
one or more regular season games; and/or (ii) that if a player willfully takes
action that has the effect of substantially undermining his ability to fully
participate and contribute in either pre-season training camp or the regular
season (including by willfully withholding his services in either pre-season
training camp or during the regular season or willfully missing one or more
games), the player may forfeit the greater of: (a) 25% of the prorated portion
of his signing bonus for the applicable League Year for the first time
such conduct occurs after the beginning of training camp until the end of
the season for his Club, and the remaining 75% prorated portion of his
signing bonus for the applicable year for the second time such conduct occurs
during that period that year; or (b) the proportionate amount of his
signing bonus allocation for each week missed (1/17th for each regular season
week or game missed).

ahhh.. you edited :)
diehard 06-16-2010, 05:34 PM I gotta feeling the Skins will win an arbitration. Haynesworth is not the model player the CBA wants to represent. Besides, Syder will have top lawyers and maybe Obama will step in...

...and since I'm not a journalist, I have to be my own editor. Not that editors seem to do much in this day and age...;)
mooby 06-16-2010, 05:53 PM It was Phillip Daniels, or so I've heard. But for all I know it could have been Fletcher himself
I can't remember where I saw this, whether it was here, on ESPN or RI, but somewhere it said Shanahan talked to Haynesworth in February and offered to release him by April 1st if he agreed to not take the option bonus. So I feel like it should be kinda obvious that Haynesworth wanted to wait so he could get that bonus money, he was probably advised by the NFLPA that if he was on the roster April 1st and he reported to all the mandatory sessions that money would be his to keep and that's why Haynesworth didn't take up the offer by April 1st.
So my questions are, do you think the Redskins have a good chance at recouping some of that money in light of it being made into a signing bonus on the contract renegotiations, and do you really think this is more about how Al feels about being pushed down the depth chart for not showing up as you previously implied in this thread? And also why would Shanny need to ask Haynesworth not to take the option bonus if they cut him by April 1st, wouldn't that have cancelled the bonus if they just cut him by April 1st? And one more question. Lets say he skips the mandatory minicamp but shows up for training camp and the Redskins have already decided to pursue arbitration on the bonus, does he stand as good of a chance as the NFLPA advised him? I remember somewhere it said the NFLPA pretty much guaranteed that bonus money would be his to keep if he was on the roster April 1st and didn't skip training camp, which it sounds like isn't in his plans.
bigdaddy2348 06-16-2010, 06:42 PM I hope he is traded and blow out both his MCL and ACL in both legs. Ending his career. Also I hope his baby momma gets the rest of his money!!!!
RedskinMike 06-16-2010, 06:50 PM You're right, I don't think this complicates next year's cap at all because of the way they restructured his $21 million signing bonus. Essentially, it only effects the 2010 roster.
But the Skins made a tactical error, in my opinion, by not cutting him before April 1st. That was their chance to unload his fat ass.
He still would have got all the money. It was guaranteed in the contract. Cutting him would only have saved base salary.
JoeRedskin 06-16-2010, 07:04 PM The 21M was only guarranteed if he was still on the team.
