I think after you get 3 miles off the coast it becomes federal waters and not the states. I know that three mile line changes what we can fish for if we are over three miles out because of this. I think the only thing that is really left to decide is how the state and the federal goverment will share in the revenue and how and to whom will they lease the rights. I'm still not sure why this is such big new other then the fact that Obama and the congress could but the ban back in force.

You will find no such explicit mention. Having said that, still no need to get in a tizzy, since Lord Obama is willing to bend some for this lowly need.

This is where a little critical thinking is required.

Regulating what goes on at sea falls under "To regulate commerce with foreign nations, and among the several states, and with the Indian tribes" powers granted to congress. I mean, how exactly does one determine what waters belong to what State? It can also fall under "[provide for] general welfare of the United States." Yes, you can make the case for banning oil drilling due to the risk of oil spills and environmental damage it can do under general welfare clause.

What exactly does the Federal Judicial Branch deal with? Issues concerning the Constitution I imagine. The mere fact that federal courts have jurisdiction implies that congress can regulate the sea.

If you're going to pedal "you will find no such explicit mention" nonsense you should be aware that congress can pass any law it wishes so long as no constitutional provisions are violated. That is to say the Constitution tells you what you can do but it doesn't necessarily mean it tells you what you can't do. There is a distinction between the two.

So to wrap this up I think its great that Obama is going to allow drilling and not put the ban back inforce. To bad I will probably be an old man by the time of the off shore rigs start operating because of all the red tape and court hearings. Now that I think about it even if I'm an old man i can still go out and see them and get a woody because I'll have federal health care to buy my Viagra.

I think it's a good move.

I could really care less who initiated it or all the particulars. I mean really, the fact that it's happening is all that really matters.
